In my view, the former chief of the army staff, Gen. Bajwa succumbed to the idea of ‘powerful globalization tendencies with focus on the steady weakening of traditional national boundaries.’ IK’s Naya Pakistan was raising the country to global eminence has no room within globalization tendencies.
The global tendencies cannot be ignored in Bajwa orchestrated regime change on April 09, 2022, to depose Imran Khan. Criminals were ushered into the government. Shabaz Sharif, the about to be convicted in a charge of money laundering became the Prime Minister.

Bajwa, inducted alleged criminals out on bail as the army’s proxy government. This clique composed of sixty-six percent with criminal record were imposed upon the people. Criminals in government renders the State without the rule of law, is automatic. Exactly this has happened. The Supreme Court (SC) Chief Justice (CJ) has Ordered elections. The CJ’s Order is disobeyed by the clique (the criminal enterprise.)
Rumored, the people of Peshawar had decided to pick up weapons worth two billion rupees to fight Asim Munir’s ill reputed army stationed in Peshawar.
The Justice system in Pakistan has collapsed. The country’s justice corridors are either filled with coward justices scared of the army to enforce the rule of law or the Justices are compromised. The legal system is not broke. It has vanished.
The latest example of the no rule of law is the May 09, 2023, abduction of Imran Khan from Islamabad High Court (IHC) by rangers reporting into the army. The rangers stormed into the IHC, breaking windows, incapacitating those in their way with a spray and took Khan into custody. ‘Arrests’ are the responsibility of the police and not the army.
The current self-created maelstrom is intentional to create planned consequences. One would think Bajwa miscalculation that Imran Khan (IK) would wilt on the vine after he was deposed would serve as guidance to change the course to save the country. In turn, IK is abducted.
The current self-created maelstrom is planned and staged. The army sensitive areas (Cantt, Lahore Corps commander house and GHQ) usually fortified with security check posts and backed with a second tier Quick Reaction Froce (QRF) were found missing to manage protesters, is perplexing. It is indicative of a staged protest putting fires and vandalizing historic landmarks.
Investigation is needed to ascertain why the premise of Lahore Corps commander house was vandalized before the rioters could enter the grounds of the corps commander’s house. A chunk of plaster from a brick wall is missing with no signs of smoke or fire.
Khan’s peaceful protestors are fired upon. Giving fatal head wounds, fifty deaths and numerous injuries. The men paid have accepted illegal orders to kill the same they had taken oath to protect.
The exchange of material goods relationship between a leader and his subordinates is disruptive to human life; they must seize and must be stopped. There is divine guidance in Surah Al-Adiyat (The Courser, The Charger) for a soldier.
The theme of Surah says, horses are more grateful to their owners than men are to their Rabb (Allah.) A horse charges by the dawn with hooves producing sparks. “Arriving thereby in the center collectively. Indeed mankind to His Lord is ungrateful.”
How must a depleted soldier lesser than a horse can resolve his conscience so he is grateful to his regiment, and His Lord? In particular, how must the officers of the Baluch Regiment resolve their conscience. My father, a Baluch Regiment officer in his book Looking Back, writes, he had no loyalty to a person or a lobby. He was loyal to his profession and country. Not this army.
The late Brig. Mian Hamid-Ud Din provides an example. He speaks of Gen. Hayaud Din, PA 18. Brig. Hamid-Ud Din writes, Gen. Hayaud Din, was loyal to his country at times to his expense. These soldiers did not have loyalty to a person or a lobby.
In this army examples of disloyalty to country abounds. The army has participated in regime change. The Pakistan army has given illegal orders to shoot her people. The army has abrogated constitution by not holding election as Ordered by the SC CJ in April 2023. The army cannot arrest Khan. The army arresting IK and detaining Khan is illegal. The officers have let the army’s downwards integrity trend to collapse on the axis by violating their oath.
The army has been untruthful to their oath to jealously guard the country from internal and external threats. The army has become the public enemy number one.
In the absence of the constitutional law and a country without institutions, where can Asim Munir be tried in a civilized manner? The trial can begin, symbolic it may be, to show Pakistan has an option. Pakistan has a course of action. When the trial begins, a great crowd will gather to see what is happening.
John Rawls’ “Theory of Justice” (reconciliation of liberty and equality) is fighting the norms of international law and practice. International law as practiced is a setback to John Rawls interpretation of “The Peoples Law,” which is his reflection of how “reasonable citizens and peoples might live together in a just world.”
To shrink Rawls’ reflection into the context of Pakistan’s localized ‘The People’s Law,’ it can raise a challenge to articulate it in International law. Nonetheless, the citizen of Pakistan must peacefully press forward. The option is the code of Pukhto to try Asim Munir under.
In the scholar Amir Hamza Shinwari’s ballard, he is referring to Pukhto as the way of life, as in a code of life. Hamza writes,
“Pukhto is not alone a single language. It is a name of culture and discipline.”
Pukhto, a several thousand years old culture and a discipline is applicable. Since Pakistanis are victims, a Pashtun and his discipline must stand with them as in a treaty. The treaty is to save the victim from the tyrant. From this treaty, the befitting hanging of Asim by neck till his death can be an outcome. Hamza baba educates us on a Pashtun’s treaty with the victim,
“Pukhto is a treaty with the victim. It is a name against the every Disgust and the Merciless.”
The Disgust and the merciless is Asim Munir—one man that has flavored the clique. Before, it was another one-man, Bajwa that poured in criminals into the government.
In Pakistan the old Right (culture, society and code of life) is joined by the new Right (IK raising a generation). The old Right is Pukhto, (Not alone a language—Pushto, but a code of life–Pashtunwali) and the new Right have adopted the vision of IK.
In the absence of the rule of law in Pakistan, now Asim Munir can be tried under more than a thousand year old law of Pukhto (or Pashto.) What this means is the old Right and the new Right have express acts that will materially interfere with the context—Asim Munir.
Together, the ancient law of the people – The Social Contracts and the Public Reasoning can emerge as the new contract of justice.
But under whose authority Pukhto code can take away life as the ‘immediate gift of the Creator’? In this article I prove my thesis. The essential questions to settle on are – Is Asim’s life “a gift or a curse”? And how an intellectual storm identifies to what is truth?
Capital punishment is rooted into Pakistan’s law and in the society, so is mercy. This mode of accepted punishment or forgiveness shall remain. Then, what do we do in the absence of law? Answers to the aforesaid two essential questions should suffice.
Here, the legal standard for my case is not the constitutional law for two reasons. First, the country is hijacked by criminals and is subjected to the law of criminals. This includes the weak-spined SC CJ and the criminal enterprise. Second, there exists thousands year old precedence of Pukhto.
Pukhto has influenced the masses. The actions from Pukhto has strengthened public reasoning. Khan’s struggles unintentional benefit to Pukhto is no longer lurking in the shadows.
Is Asim’s life “a gift or a curse”? Munir is assisting with the regime change of April 09, 2022, wherein, CJ Bandial blatantly violated the constitution. Bandial interfered in Parliament’s proceedings and contradicted the SC precedence set in case, Const. P No. NIL/2022-SCJ, April 2, 2022, “Under Article 69 […] validity of any proceedings in Parliament cannot be called in question.” Bandial overturned the Parliament’s decision to dissolve assemblies. In the question of “a gift or a curse,” Ali Bilal, a special child is murdered; police abducted a ten-year old in a home search when they did not find his father, a person in political opposition. Now, forcing the country into crisis by abducting IK.
On the question of how an intellectual storm identifies to what is truth? We examine the current state, and what truth to use to get to the future state. That is, the possibility of hanging Asim Munir by the neck till his death with the established code of life Pukhto.
Aside from criminality, the Joint Criminal Enterprise prior to Khan’s arrest has violated the Lahore High Court Orders. The Lahore High Court issued specific Orders for the law enforcement agencies to search Khan’s home. The Order requires two individuals. One is a police officer in the rank of Superintendent Police (SP) to search Khan’s home in the presence of the second person—Khan’s appointed person.
On March 18, 2023, Khan home is raided by a mass of police during Khan’s absence. The police is feasting, ransacking, destroying and vandalized his home while he is away. On social media police is seen drinking Khan’s soft-drinks, hauling his furniture, destroying his children’s memorabilia and planting evidence shamelessly in Khan’s home in broad daylight.
Later, Khan finds out the clique has secured a search warrant from the Anti-Terrorist Court, is kept a secret, which required two police officers, including a lady officer. Instead, the mass of police raided Khan’s home after demolishing the front entrance with track hoe. Whereas, a knock on the door would have sufficed.
The country’s institutions have turned a blind eye to the state of lawlessness, extrajudicial and custodial killings. The State’s defenders have become the predators. The nation is cold dead addressing Asim Munir as Khan speaks of the Joint Criminal Enterprise plans to kill him during his court hearing by attempting to create chaos and disruption and after inciting people to kill Khan in cross fire.
The majority of the nation (Punjab and Sind province) is born into accepting the color of slavery. When Khan says he will be killed by the clique, Pakistanis find it similar to as if listening to Eliot Morison, the authority on Columbus who writes about Columbus’s genocide “buried halfway…[into] a grand romance.” Pakistanis are stagnant.

Albert Einstein gave us many truths and we have accepted them. The theory of Relativity earned Einstein a Nobel Prize, and later he found another truth, Energy = MC2 . With this far reaching base knowledge, scientist are exploring other truths. –Id.
There are many truths in culture with a far reaching knowledge base, which when attempted to defy, denialism is put in place to make it (Pukhto) vanish. The British, the Soviet Union and Americans, all three have attempted fate to test out the truth in Pukhto.
What is remaining intact in Pakistan to address the current situation is Pukhto as the rule of law—the truth. To set the grounds for instilling justice and the rule of law in Pakistan, I had previously rendered translation of definition of Pukhto given to us by the scholar and a poet Hamza ‘s ballad titled, Pukhto.
In Pukhto, there lives Pakistanis’ right and privilege to try Asim Munir. To set him free or to order a death sentence as if he is tried in any civilized society with due process . The difference between the Western law and Pukhto is; Pukhto is a continuous due process. The moment one fails, he is told, “You have no Pukhto” (or Pashtunwali) and a verdict ( a feeling of correction) is rendered there and then to maintain the plight of living with pleasure.

Gen. Syed Imad Hussain Shah, DGF Maj. Gen. Shabaz Tabassum, ISI Sector Cmdr Brig. Fahim Raza, Lt. Gen. Mohd. Aamer (Corps Gujrawala), Lt. Gen. Shahid Imtiaz, Lt. Gen. Asif Ghafoor, Lt. Gen. Critics may say crimes of the nature committed in broad daylight at the point of a gun or violating judicial duty still requires the “greatest deliberation and the fullest conviction of our own authority.” That truth is now Pukhto’s writ.
In the absence of law in Pakistan, we are left with a tried and tested thousands of years old a way of life. This code has banished individuals in the past not fit for a decent society. Some left for Africa never to return.
Pashtuns are not immune from the psychotic clique threatening their family members. However, the premium in Pukhto has defense mechanism against threats. Amir Humza Shinwar baba makes us peek into this inbuilt defense, but then refutes it with zealous guard in the second verse,
“They say, in Pukhto there is half Kafiri [practice of a Kafir]. [Those that say this] is the name of the lost and indignity.”
The simile to kafiri has a clear and a distinct message to the Joint Criminal Enterprise. If one threatens Pashtuns, he faces danger. The Kafiri in Pukhto can likely become the cause, God forbid, digging their mothers out of graves in revenge.
But the act of digging the dead is heinous and that the Pukhto’s discipline and code equates to heaven, shall disallow indignities. Shinwar baba’s ballard has guidance.
Though Pakhto at times is harsh and beautiful, Hamza Shinwar baba answers to those that equates Pukhto to Kafiri and encapsulates Pukhto in its entirety in the last two verses to its eternal value to the people,
“But in response replies Hamza. Pukhto, my dear one is the name of heaven.”
Though there exists a swift justice in Pukhto. The heads of each concentric circles in Pukhto can prescribe to justice, defense and offense. Khan was released from his captivity. Some say, Supreme Court ordered his release in the land without the rule of law. Others have rumored it was Pukhto.
For this rumored reason the army and allegedly the immoral SC Justice Athar Minullah insisted upon Khan, to go on television and call off protesting. Their plea to Khan is rumored was to avoid an imminent assault on the army.
The night of May 10, 2023, from Pukhto, the Pashtuns had gathered weapons, totaling two billion rupees and had agreed to assault Asim Munir’s army of ill repute stationed in Peshawar. This act can symbolize, “Pukhto, my dear one is the name of heaven.”
Pakistan’s greatest potential is in Punjab’s newly found courage. Together, all in this struggle are to realize a model to follow. It is, that after birth, Pukhto becomes a genetic code that if made “near-universal” within all life on Earth, the earth will meet heaven.”
Pukhto is John Rawls’ thesis. Pukhto is John Rawls “The Peoples Law,” which is his reflection of how “peoples might live together in a just world.” If not the world, Pukhto is a passage to a just society in Pakistan.
The main theme of this article was written in April 2023, before IK’s arrest. Where I had predicated Pukhto will face up to Munir because Pukhto is a treaty with the victim; Pukhto has to live.
